The Receiving Party’s confidentiality obligations terminate for information it can document was already lawfully known to it at the time of disclosure so that pre-existing knowledge is excluded from protection duties.

The Receiving Party’s obligations under Section 8.1 (Protection) above with respect to any Confidential Information of the Disclosing Party will terminate
