When a Participating Affiliate uses an existing Software Order, references to Customer in the applicable Software Order and Agreement are deemed to include both Customer and the Participating Affiliate, and they are jointly and severally liable for compliance, while Customer bears full liability to Zeroth for the Participating Affiliate’s acts and omissions.
